As reported last week in the Post and Courier, the S.C. House Criminal Laws Subcommittee panel passed Emma’s Law on March 20, 2014. The bill is named after a 6 year old Columbia girl who was killed by a drunk driver. If passed, this Law will require those charged with a DUI in Charleston South Carolina and the rest of the state to have an ignition interlock system installed in their car. The ignition interlock system takes breath samples from the person starting the car before the vehicle can be started. All of the samples and data are stored in the device until the information is retrieved at the maintenance check-ins and reported to the appropriate agency. This bill had been previously passed through the senate and is now one step closer. The next step is for another House Committee to review the bill and then they hope to vote on the bill to put it into existence. Before the bill passed through the House Panel, there were several changes made that some say “Weakened” the bill. A few of the differences were that only those convicted of DUI would have to get an interlock system installed, this is in opposition to Senator Joe Lourie’s original bill which required anyone charged with a DUI. Another change is anyone convicted of DUI who gave a breath sample of.15 or higher would have to have the interlock system installed, where the original bill required only.12 or higher. All parties of the SC Senate and House seem optimistic that this bill will be passed later this year.
